AI models often operate as "black boxes," producing outputs based on complex algorithms that are not always transparent. While an AI might generate "investigative leads" or "probabilities," these are not synonymous with proof. Consider the implications: an AI model that cannot consistently reproduce the same finding from the same data set, or whose probabilistic outputs are treated as definitive evidence, fundamentally undermines the legal standard of proof. We have already seen instances where unverified AI outputs have led to grave injustices, from misidentifications to absurdly flawed police reports.

Similarly, in OSINT (Open Source Intelligence), while AI can aggregate and analyze public data, the critical assessment of source reliability, contextualization of information, and the nuanced understanding required for actionable intelligence remain firmly within the human domain. The rule remains unwavering: the tool's output is where the investigator's work begins, requiring meticulous human verification against original sources and surrounding records.

Empowering Practitioners to Shape the Future

To navigate this evolving landscape successfully, decisions about digital investigations, especially concerning AI implementation, must be shaped by those with boots on the ground. Practitioners, with their direct experience of inaccessible evidence, tool limitations, staffing gaps, and the difficulty of defending technical findings in court, possess the invaluable insights needed to build resilient and reliable forensic processes.
